• You agree to accept responsibility for all activities that occur under your account
• We reserve the right to modify these Terms at any time

2. Description of Service

The Racing Mail provides horse racing market analysis tools using proprietary frameworks (Form Stability Lens, Market Pressure Lens). Our service includes:

• Automated race analysis using mathematical models
• Historical form data and performance statistics
• Subscription-based access to advanced features
• Educational tools for understanding racing form

This service is PROVIDED "AS IS" for informational and entertainment purposes only.

4. User Responsibilities & Prohibited Conduct

You agree to:

• Provide accurate and complete registration information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use
• Use the Service in compliance with all applicable laws
• Comply with Australian gambling regulations in your state/territory

You agree NOT to:

• Use the Service if you are under 18 years old
• Share your account or subscription with others
• Scrape, copy, or redistribute our analysis or data
• Reverse engineer or attempt to access our algorithms
• Use automated tools (bots) to access the Service
• Violate any laws or regulations
• Attempt to harm or disrupt the Service

Billing

• Subscriptions are billed monthly or annually (as selected)
• Payments processed securely via Stripe
• Automatic renewal unless cancelled
• Prices subject to change with 30 days notice
• No refunds for partial months (see Refund Policy)

Cancellation

• You may cancel anytime from your account settings
• Access continues until end of billing period
• No refunds for remaining days in billing cycle

6. Intellectual Property Rights

All content, features, and functionality of the Service (including but not limited to algorithms, software, text, graphics, logos, and analysis systems) are owned by The Racing Mail and are protected by Australian and international copyright, trademark, and other intellectual property laws.

• Your License: We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial use only
• Restrictions: You may NOT copy, modify, distribute, sell, or lease any part of our Service or algorithms
• Your Content: You retain rights to data you input, but grant us license to use it to provide the Service
• Trademarks: The Racing Mail, Form Stability Lens, Market Pressure Lens, and our logos are trademarks and may not be used without permission

7. Data Accuracy & Service Limitations

While we strive for accuracy, we cannot guarantee:

• Data Currency: Race data may not reflect last-minute changes (scratchings, jockey changes, track conditions)
• Third-Party Data: We rely on external data sources (Punting Form API, etc.) which may contain errors
• Service Availability: Uninterrupted or error-free access (maintenance, outages may occur)
• Analysis Accuracy: Our algorithms are models and cannot predict with certainty
• Updates: Always verify current race conditions before making any decisions

You acknowledge that horse racing outcomes are unpredictable and that our analysis is only one tool among many.

9. Account Termination

By You

• You may delete your account at any time from settings
• Deleting your account does not entitle you to a refund

By Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• Your payment fails or is reversed
• You abuse or misuse the Service
• At our sole discretion for any legitimate reason

Upon termination, your right to access the Service immediately ceases.

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which complies with the Australian Privacy Act 1988 and Australian Privacy Principles (APPs).

• Your data is encrypted and protected with industry-standard security
• We do NOT sell your personal information
• You have rights to access, correct, and delete your data

11. Governing Law & Dispute Resolution

• Governing Law: These Terms are governed by the laws of New South Wales, Australia
• Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales
• Gambling Compliance: You are responsible for complying with gambling laws in your state/territory
• Consumer Rights: These Terms do not affect your statutory rights under Australian Consumer Law

Dispute Resolution

• Contact Us First: Email support@thewrongprice.com to resolve issues
• Mediation: We agree to attempt good-faith mediation before litigation
• Small Claims: You may file a claim in small claims court if applicable

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will:

• Provide at least 30 days notice prior to new terms taking effect
• Notify you via email or prominent notice on the Service
• Update the "Last Updated" date at the top of this page

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
